Information according to art. 13, 14 and 21 of the General Data Protection Regulation (GDPR)

Dear Candidate,

in accordance with art. 13, 14 and 21 GDPR (regardless of whether you are resident in the EU or not), we inform you about the processing of your personal data and about claims and rights that you have under the provisions of the regulations concerning protection of personal data.

What specific data is processed and how it is used depends to a large extent on the services ordered or agreed upon.

We process personal data that you provide to us as part of the application process. In addition, we process data that you publish and make available to us on external career platforms for purposes related to the application. Important personal data is: personal details (name and surname, address, contact details (e-mail address, telephone number), date and place of birth, citizenship, education, references and certificates).

We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR):

a) in order to take action before the conclusion of the contract (Article 6 (1) (b) of GDPR)

The processing of personal data (Article 4, Clause 2 of the GDPR) takes place in order to investigate, establish contact and initiate potential future cooperation and takes place at your request.

b) to determine the overriding nature of interests (Article 6 (1) (f) of the GDPR)

In order to find the right position/function for you, it is necessary to submit application documents to specialist departments of our companies and relevant entities. We process your data that goes beyond the actual implementation of the application to set up and establish an employment relationship.

c) based on your consent (Article 6, Clause 1a of the GDPR)

If you have consented to the storage and processing of data as part of an extended recruitment process and to include them in the "talent pool" (on our separate request), this processing is lawful on the basis of your consent. The consent may be revoked at any time. Please, note that the appeal will only apply in the future. The processing that took place before the cancellation took place – remains unchanged.

your employment request. For those purposes, the data may also be transferred to the recruiting entities employed by us (Article 28 of the GDPR). These can be companies operating in the field of candidate management or in the category of personnel consultancy (e.g. in the area of ​​evaluation).

The other recipients of the data may be those you consent to transfer the data to.

Your personal data is stored for the duration of the application process.

If the employment relationship is not established, your data will be deleted after 3 months from the date of the last contact (e.g. job interview, letter confirming the candidate's rejection). If necessary, we process and store your personal data for the duration of the application process, which also includes, for example, the initiation and performance of a contract of employment. Finally, the storage period is also assessed in accordance with statutory limitation periods.

Sending data to countries outside the European Economic Area (EEA) is done in order to secure data in our server facilities in Bützberg (Switzerland) and Oftringen (Switzerland) within the Glas Trösch Group, so that in case of failure or attack on our IT systems it is possible to restore it as soon as possible.

The data is stored on a server in the Netherlands via the external "Talentsoft" recruitment portal. We have a contract for on-demand processing that meets data protection requirements.

In addition, the transfer takes place only when it is necessary for the implementation of your application or if you have given your consent.

Any data subject who has his or her residence in the EU has the right to access under Art. 15 of the GDPR, the right to correct under Art. 16 of the GDPR, the right to remove under Art. 17 of the GDPR, the right to limit the processing under Art. 18 of the GDPR and the right to transfer data pursuant to Art. 20 of the GDPR. With regard to the right to access to data and the right to remove, restrictions apply in accordance with § 34 and § 35 of the Federal Data Protection Act (BDSG). In addition, there is the right to lodge a complaint with the data protection supervisory authority (Article 77 of the GDPR in connection with § 19 of the Federal Data Protection Act, BDSG).

As part of the application, you must provide only that personal data that is necessary to establish, implement and initiate an employment relationship or which we are legally obliged to collect. Without this data, we will not be able to process your application or enter into a contract of employment.

We do not use, in principle, a fully automated decision-making system as defined in Art. 22 of the GDPR in order to initiate and conduct application process.

Right to object in an individual case:

You have the right to object at any time to the processing of your personal data pursuant to Art. 6, Clause 1, Letter e) of GDPR (data processing in the public interest) and Art. 6, Clause 1, Letter f) of the general regulation on data protection (processing of data after determining the overriding nature of interests) for reasons arising from your particular situation. If you raise an objection, we will no longer process your personal information unless we demonstrate that there are good reasons to protect in connection with processing that outweigh your interests, rights and freedoms, or that the processing is used to claim, enforce or defend legal claims.
